Welcome to Talvo! These Terms of Service ("Terms") govern your access to and use of the Talvo mobile application, website, and related services (collectively, the "Service").
Please read these Terms carefully before using the Service. By creating an account, connecting a bank account, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. About the Service
Talvo is a personal finance tracking and budgeting application designed to help you aggregate, categorize, and analyze your financial transactions.
- No Financial Advice: Talvo is an information and organization tool. We do not provide investment, financial, legal, tax, or banking advice. Any insights, trends, or categorization provided by the Service are for informational purposes only. You are solely responsible for any financial decisions you make.
- Not a Financial Institution: Talvo is not a bank, investment firm, or credit institution. We do not hold, manage, or transfer your funds.
2. Eligibility and Account Registration
To use Talvo, you must meet the following requirements:
- You must be at least 18 years old (or the age of majority in your jurisdiction).
- You must provide an accurate and active email address during registration.
- You are responsible for maintaining the confidentiality of your account credentials (such as your password or login tokens) and for all activities that occur under your account.
- You agree to notify us immediately at
info@gettalvo.com if you suspect any unauthorized access to or use of your account.
3. Bank Connections and Open Banking (PSD2)
Talvo allows you to retrieve your financial data by linking your bank accounts.
- Service Providers: To retrieve your transaction history and account balances safely, Talvo partners with licensed third-party Account Information Service Providers (AISPs). Our primary open banking partner is Enable Banking.
- Your Consent: By linking a bank account, you grant Talvo and our partner(s) explicit permission to access and retrieve your account information and transaction history from your financial institution on your behalf.
- Security: Talvo does not see or store your bank login credentials (such as PINs, passwords, or Multi-Factor Authentication codes). Authentication is handled directly and securely within your bank's native environment.
- Control: You can disconnect your bank accounts from Talvo at any time through the app settings, which will immediately stop further data retrieval.
4. Fees, Subscriptions, and Billing
Parts of the Service may be subject to a paid subscription ("Premium Features").
- Pricing: Subscription fees and billing cycles (e.g., monthly or annually) are displayed clearly within the app or on our website before you complete your purchase.
- Automatic Renewal: Unless stated otherwise, subscriptions renew automatically at the end of each billing cycle under the same conditions, unless you cancel your subscription before the renewal date.
- Cancellation: You may cancel your subscription at any time through your app store account settings (Apple App Store / Google Play Store) or your billing portal. Your premium access will remain active until the end of the current billing period.
- Refunds: Except as required by local consumer protection laws (such as the EU's 14-day withdrawal period for digital services, provided you have not actively used the premium features during that time), paid subscription fees are non-refundable.
5. Acceptable Use of the Service
You agree not to use the Service to:
- Violate any applicable local, national, or international laws or regulations.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Talvo application.
- Interfere with, disrupt, or hack our servers, databases, or networks.
- Use automated systems (such as bots, scrapers, or spiders) to extract data from the Service without our prior written consent.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
6. Intellectual Property
All rights, title, and interest in and to the Service (excluding your raw financial data) — including the application code, design, user interface, logos, branding, trademarks, and text — are and will remain the exclusive property of Talvo and its licensors.
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Talvo application on your personal device solely for your personal, non-commercial use in accordance with these Terms.
7. Termination and Account Deletion
- By You: You can delete your Talvo account at any time through the settings menu in the app. Upon deletion, all of your personal and financial data will be permanently removed from our production databases, as described in our Privacy Policy.
- By Us: We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or if we discontinue the Service.
8. Limitation of Liability and Disclaimer of Warranties
- "As Is" Basis: The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- No Guarantee of Accuracy: While we strive to provide accurate automated categorization and balance tracking, we do not guarantee that the financial data retrieved from your bank or the analysis generated by Talvo is error-free, complete, or up-to-date.
- API Availability: Because bank connections rely on third-party Open Banking APIs and your bank's infrastructure, we cannot guarantee uninterrupted access to bank synchronization features.
- Limitation of Damages: To the maximum extent permitted by applicable law, Talvo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or financial assets resulting from your use of, or inability to use, the Service.
9. Governing Law and Jurisdiction
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Antwerp, Belgium.
